englischThe research for possible commitment of criminal offenses in the case of the organ transplantation scandal attempted includes a detailed presentation of the view prevailing in literature and case-law as well as considerable concerns about the acquittal of the accused doctor represented by the BGH. First, the behavior of the offender is examined and the possibility of an indirect offense is assumed. In the following, an attempt is made to establish a causal connection between the change in the order of allocation and the occurrence of death or the bodily harm of the displaced patients. It also concludes that the protective purpose of the distribution rules can be associated with the rescue of all patients on a waiting list and that the transplant surgeon in redistributing the organ allocation process behaved with dolus eventualis. The author gives a detailed overview of all critical questions of medical criminal law.
