englischBy deciding for or against the continuation of a fixed-term employment relationship, the employer exercises his freedom of contract. However, this freedom is not unrestricted. The thesis examines how free the employer is in deciding whether to continue fixed-term employment relationships and explores the protection of fixed-term employees in the continuation situation. It deals with protection of employment, self-commitment, equal treatment, prohibitions of discrimination and the position of works council members in the continuation situation. In terms of collective labour law, the works council's possibilities of influencing the continuation decision are analyzed.
Der Arbeitgeber übt mit der Entscheidung für oder gegen die Fortsetzung des befristeten Arbeitsverhältnisses seine durch Art. 12 Abs. 1 GG geschützte Vertragsfortsetzungsfreiheit aus. Diese besteht jedoch nicht uneingeschränkt. Die Arbeit untersucht die rechtliche Bindung des Arbeitgebers bei der Fortsetzungsentscheidung und lotet den Schutz befristet Beschäftigter in der Fortsetzungssituation aus. Dabei geht es um Bestandsschutz, Selbstbindung, den allgemeinen arbeitsrechtlichen Gleichbehandlungsgrundsatz, besondere Benachteiligungsverbote sowie die Rechtsstellung von Betriebsratsmitgliedern in der Fortsetzungssituation. Kollektivarbeitsrechtlich werden die Einflussmöglichkeiten des Betriebsrats auf die Fortsetzungsentscheidung analysiert.
