englischCorporations are facing new challenges created by the „Act for equal participation of women and men in leading positions“. First, listed and parity-based codetermined corporations have to fulfil a strict gender quota for the supervisory board. Furthermore, an obligation to define targets for the number of women in leading positions exists for smaller corporations as well. The book dogmatically deals with the details of these provisions and examines the difficulties arising from the interpretation and application to stock companies, limited liability companies, European companies and companies resulting from cross-border mergers. Therefore, the handling in practice up to now is evaluated. In order to find a solution, improvement suggestions for the legal provisions are made and more detailed rules for the articles of association or the rules of procedure are drafted.
