englischThe paper examines possible approaches to resolving the conflict between the constitutional requirement of Sunday rest and the interests of shopkeepers seeking a liberal regulation of additional sales Sundays. It focuses on whether the merely limited possibilities of opening on Sundays comply with the shopkeepers' freedom of occupation (Berufsfreiheit) under Article 12 of the Constitution and which requirements the legislator would have to meet with respect to Article 139 of the Weimar Constitution (in conjunction with Article 140 of the Constitution) when liberalising the regulations on additional sales Sundays. Furthermore, the paper examines inter alia the justiciability of the constitutional protection of Sundays as well as the constitutionality of selected current legislative developments.
