englischThe work deals with the question of when a criminal liability due to a breach of trust (para. 266 StGB) must be considered. In addition to general questions on the dogmatic of high-risk transactions, all the obligations that are to be considered when engaging in investment transactions are covered and categorized. The work focuses on applying and translating the interpretations of the specific cases of investment transactions with the aim of compiling a practical handbook on breach of trust in the context of investment transactions.
Die Arbeit befasst sich mit der Frage, wann bei Investmentgeschäften eine Strafbarkeit wegen Untreue (§ 266 StGB) in Betracht kommt. Neben allgemeinen Fragen der Risikogeschäftsdogmatik werden all jene Pflichten behandelt und kategorisiert, die bei der Vornahme von Investmentgeschäften zu beachten sind. Dabei konzentriert sich die Arbeit auf eine Anwendung und Übertragung der tradierten Auslegungen auf die speziellen Fälle des Investmentgeschäfte, um so ein praxistaugliches Handbuch zur Investmentuntreue zu schaffen.
