englischWhat answers does the law offer to religious pluralism in society and to what extent can religious rules be integrated into German constitutional law? In religiously pluralistic societies, tensions exist between state neutrality and the state’s guarantee of basic rights as well as between ius cogens and private autonomy. This work examines which rules regarding family and inheritance law can be implemented in this context. Structural possibilities include: an optional alternative law that would apply in parallel to the current law, arbitration agreements, marriage contracts and contracts of inheritance. The study also discusses different forms of divorce, divorce claims and questions of inheritance law. The model of Singapore as a secular state with a binding Islamic law for Muslims in family and inheritance matters serves as a foundation for the study and highlights certain problems and advantages.
