The goal of climate protection and the fundamental transformation of the energy supply have once again raised, inter alia, the question of the competences of municipal authorities. Against this background the author deals with the legal admissibility of compulsory connection and usage, especially concerning heating networks, restrictions to be observed as well as necessary exceptions. The author considers the question of whether compulsory connection and usage is of particular importance in times of climate change and energy revolution or whether a loss of significance is to be noticed. Thereby, also provisions of federal law, especially sec. 16 of the Renewable Energies in the Heat Sector Promotion Act, and their impact on the admissibility of compulsory connection and usage are taken into account.
Die Schlagwörter Klimawandel und Energiewende stehen für eine Reihe von Änderungen der rechtlichen und tatsächlichen Rahmenbedingungen, die auch Auswirkungen auf klassische Handlungsinstrumente wie den kommunalen Anschluss- und Benutzungszwang entfalten. Das Ziel des Klimaschutzes sowie der Transformation der Energieversorgung haben u.a. die Frage nach den rechtlichen Handlungsmöglichkeiten der Kommunen neu aufgeworfen. Vor diesem Hintergrund befasst sich die Autorin mit der Zulässigkeit eines Anschluss- und Benutzungszwangs, insbesondere an Wärmenetze, den zu beachtenden Einschränkungen und erforderlichen Ausnahmen. Sie geht dabei der Frage nach, ob dem Anschluss- und Benutzungszwang in Zeiten von Klimawandel und Energiewende eine besondere Rolle zugewiesen ist oder künftig ein Bedeutungsverlust dieses Instituts zu beobachten sein wird. Dabei werden auch Vorschriften des Bundesrechts, insbesondere § 16 EEWärmeG, und ihre Auswirkungen auf die nach Landesrecht bestehenden Möglichkeiten der Einführung eines Anschluss- und Benutzungszwangs in den Blick genommen.
