englischThis work examines the civil liability of the issuer and the board members responsible for providing inaccurate financial reports to investors in the capital market. Given the fact that the liability for inaccurate financial reporting, which unlike publicity liability is not ad hoc, has not been regulated so far by special law, this dissertation examines the extent to which investors are entitled to a liability claim if they have paid too much for securities or sold securities too cheaply as a result of being regularly fed inaccurate reports. It points out that the extent of liability claims submitted for errors made in an annual financial report and in interim reports published during the year on the basis of the current legal situation is extremely narrow. In view of this, the author proposes a set of regulations with which to close the loopholes within the framework of civil liability for providing inaccurate financial reports to investors in the capital market.
