It provides answers to many open questions: the question of whether there is a duty under employment law to make statements in the context of internal investigations; the admissibility of internal investigations; legal duties to carry out internal investigations; the limits of substantive law; the right to refuse to testify and give evidence concerning internal investigation results in the context of a criminal case; the question of whether the records of an internal investigation are exempt from seizure; the duties of internal investigators to provide instructions and keep proper records; and the inadmissibility of evidence in breach of the nemo tenetur principle and the right to a fair trial.
