Pharmaceuticals do have a potential risk of abuse and to health. Therefore, especially sales promotion activities are strictly regulated in the pharmaceutical sector, which is the subject of this work. Based on the decisions of the Supreme Court of September 2010, the author examines and compares the admissibility of sales promotion activities in general and in the pharmaceutical sector in Germany as well as in Austria and Switzerland. Of particular interest is how these countries deal with the admissibility of sales promotion activities for the purchase of prescription-only pharmaceuticals as well as the applicability of national price law for foreign mail-order pharmacies addressing the national market.
