englischThe direct payment in the tenancy means that the state is directly involved in the fulfilment of the tenant's obligation. The author first categorises the optional and obligatory direct payments according to § 22 (7) SGB II. She then examines the question of whether the job centre becomes the tenant's agent when it pays the rent directly to the landlord at the tenant's request, and what effects this has on the debt relationship. It also examines how, and in particular by what legal means, payments made to the landlord in error can be reclaimed.
Durch die Direktzahlung im Mietverhältnis wird der Staat unmittelbar in die Erfüllung der Verbindlichkeit des Mieters eingeschaltet. Die Autorin nimmt zunächst eine rechtliche Einordnung der fakultativen und der obligatorischen Direktzahlung nach § 22 Abs. 7 SGB II vor. Sodann geht sie der Frage nach, ob das Jobcenter Erfüllungsgehilfe des Mieters wird, wenn es auf Antrag des leistungsberechtigten Mieters die Miete direkt an den Vermieter zahlt, und welche Auswirkungen dies auf das Schuldverhältnis hat. Ferner wird untersucht, wie und vor allem auf welchem Rechtsweg zu Unrecht an den Vermieter geleistete Zahlungen zurückgefordert werden können.
