englischThis dissertation examines the legal structures of escrow investments and joint property investments. It compares the historical development of these fundamental forms of investment funds and presents their structural approximation as a result of the implementation of Germany’s capital investment code, the Kapitalanlagegesetzbuch (KAGB). In doing so, it focuses on the legal nature of the placement and administration of investment funds, the allocation and withdrawal of shares, along with different contingent liabilities. The study highlights in which areas the implementation of the KAGB has led to escrow investments overlaying joint property investments.
