Die Studie behandelt die Frage, ob sich die Verantwortlichen bei EU-lizensierten Anbietern von Online-Casinospielen ohne inländische Erlaubnis wegen unerlaubten Veranstaltens eines Glückspiels gemäß § 284 StGB strafbar machen. Die Antwort auf diese Frage richtet sich danach, wie man die Unrechtsstruktur der Strafnorm interpretiert. Versteht man die Strafnorm zutreffend verwaltungsrechtsakzessorisch, so wird ihre Anwendung abhängig von der Unionrechts- und Verfassungskonformität des nationalen Glücksspielverwaltungsrechts. Da die Unionsrechtskonformität des Verbots von Online-Casinos nach deutschem Glücksspielverwaltungsrecht derzeit unklar ist, ist § 284 StGB seit 2006 auf EU-lizensierte Anbieter von Online-Casinos nicht anwendbar. Ein derart neutralisiertes Strafrecht wird dann problematisch, wenn es wie § 284 StGB zur Dauererscheinung avanciert.

englischThe study discusses the question whether the people in charge at EU-licensed providers of online casino gambling without a domestic license can be rendered liable to prosecution for illegal gambling as per sec 284 German Criminal Code. The answer to that question depends on how the structures of the relevant criminal provision are interpreted. Appropriately defining the criminal provison as being accessory to administrative law, its implementation depends on both EU law and constitutional conformity of national German administrative gambling law. Since it remains uncertain whether the prohibition of online casinos through German administrative law is compatible with EU law, sec. 284 German Criminal Code is non applicable to EU-licensed providers of online casinos since 2006. Such neutralised criminal law causes trouble if it evolves into a long-running phenomenon like sec. 284 German Criminal Code. The study is addressed to all whom are interested in questions concering gambling law as well as criminal lawyers and jurists.
