Details
The anthology combines 25 selected texts on criminal property law in the broader sense from 1991 to 2017. They cover subjects ranging from reflections on the legal theory of asset protection through criminal law, basic and detailed issues of property crimes, financial and insolvency offences, of corruption and breaches of trust, to a systematic record of the sanctions of European antitrust law. The individual treatises are connected in two respects by a common objective. Firstly, they are attempts to include the rules of the general section in the design of individual offenses. In this respect, the texts occasionally have an “experimental” character and deviate from well-trodden paths of handed-down interpretations and provisions on protective purposes. Secondly, the investigations are grounded in the aim of not viewing the offences of criminal property law in isolation, but instead to integrate them into an at least rudimentary system. This systematisation is supposed to avoid conflicts of value, not only between individual offences, but also in relation to civil law. The rejection of a factual in favour of an approach that is wholly normative and accessory to civil law is characteristic.
