Immigration dentention (meaning detention pending deportation) is considered a central instrument of current repatriation policy. However, practitioners repeatedly report high error rates in court detention orders. Data from the federal states that confirm or refute this does not exist.
The study addresses this data deficit through a quantitative content analysis of the case law of the Federal Court of Justice. The data obtained provides information on the frequency and causes of legally established irregularities. On this basis, the study identifies structural problems and develops approaches for improving the application and enforcement of the law.
