The thesis analyses, from a German point of view, the most extensive consensual procedure in French criminal law which is most similar to plea bargaining („Comparution sur reconnaissance préalable de culpabilité“) and compares it with other consensual procedures in French and German criminal law. In this procedure, the prosecutor offers a sentence to the defendant who admits his guilt. Upon conclusion of a public hearing, the judge subsequently confirms the sentence. The thesis also examines the compatibility of this practice with principles of criminal procedure and points out its particularities, such as the imperative to involve a duty solicitor, separation from the normal procedure, preexisting confession, public hearing, judicial review, exclusion of certain groups of offenders (who tend to make false confessions) and a limited field of application. By referring to statistics and studies, the thesis demonstrates the practical value of the discussed questions and the described procedures.
