What considerations lie behind the vague legal concept of equity (Latin: aequitas)? The author deals with this question by including the legal doctrine of the jurist Christian Thomasius.
In the blossoms of the Enlightenment, Thomasius had two dissertations written in 1706 and 1717, dealing with aequitas and aequitas cerebrina. Here he draws on anthropological, moral philosophical and also state philosophical considerations and provides a comprehensive picture of his understanding of both constructs. This is accompanied by a consideration of the law, which is torn between the progressive thinking of the Enlightenment and the respect for absolute state power.
