Description
The “alternative conflict resolution procedure“ (Güterichterverfahren) is a practise to implement the idea of alternative conflict resolution within Germany’s judicial system. It is also an instrument within Germany’s social courts system that deals with questions of social security, especially social insurance and social assistance. The constitutional status and the options the alternative conflict resolution judge can use are still unclear in many respects.
The book examines the constitutional framework an alternative conflict resolution judge must comply with and the procedural choices he or she can make. Based on extensive experience in handling alternative conflict resolution cases, the author develops answers that meet the requirements of the judiciary and those who practice law.
The author, a long-time judge in Bavaria’s social court system, has been dealing with alternative conflict resolution cases for many years.
