The 10th Amendment introduced Section 39a into the Act against Restraints of Competition (GWB). It gives the Bundeskartellamt the power to impose on individual companies identified by the Bundeskartellamt the obligation to notify proposed mergers to the Bundeskartellamt, even if the thresholds in Section 35 GWB are not met. This imposes considerable additional burden on the companies concerned, which need to be justified. This book deals with the legal framework of the new provision, the constitutional objections to it as well as the requirements that must be met for the Bundeskartellamt to issue an order.
