Description
This work examines the tort liability of globally active companies for human rights violations committed by their suppliers or subsidiaries along their global supply chains. The first part of the work adresses the question of whether, de lege lata, the Act on Corporate Due Diligence Obligations in Supply Chains (LkSG), which came into force on January 1, 2023, could serve as a basis for claims for damages under § 823 of the German Civil Code (BGB), despite the liability exclusion regulated in § 3 para. 3 sentence 1 LkSG. The second part of the thesis examines the key liability hurdles under Art. 29 CSDDD, ranging from its applicability under international private law to its procedural enforcement.
