This work examines non-contractual liability in accidents involving self-driving vehicles. The focus is on the liability of the owner under the Road Traffic Act as well as the manufacturer's liability under the Product Liability Directive and the principles of producer liability. In view of the owner's lack of control over the vehicle, it is questioned whether the existing legal distribution of liability is still justified. The work analyzes the German legal situation, in particular the Act on Autonomous Driving and the European regulatory proposals (AI Act, AI Liability Directive and Product Liability Directive), and concludes with a reform proposal to adapt liability law to the technological innovations.
