Are Automated Suspicion Algorithms at the interface between the private sector and law enforcement the future of combating crime? The author examines the tense relationship between the application of AI in law enforcement, the protection of data subjects' rights and the rule of law and constitutional requirements. Particular attention is paid to the EU AI Act in the interplay of the relevant regulations. Based on the results, the author derives minimum requirements for the use of such technology and, among other things, establishes a “blind justification requirement” for the first time. Finally, she proposes a two-track AI system for the legally compliant elucidation of the dark field of money laundering.
