Begründungspflichten des Gemeinsamen Bundesausschusses

The Federal Joint Committee has a central role in the system of statutory health insurance, its decisions being largely binding for insured persons. This makes the background of the decisions all the more important. To ensure that these decisions remain comprehensible and transparent, the German Social Code, Book Five imposes several legal obligations on the Federal Joint Committee to provide reasons for its decisions. This study examines and structures these current statutory obligations to provide reasons including the requirements elaborated in the case law of the social courts. It proceeds to explore further legal basis for the obligation to provide reasons and whether they might be transferred to the Federal Joint Committee.
