Possession – a seminal topic in German civil law – continues to raise difficult questions in everyday life. This work examines the doctrine of possession both historically and dogmatically. It emphasises the importance of legal tradition for understanding the concept of possession as such and the acquisition of possession in the German Civil Code. Important court decisions are analysed to show their influence on the development of legal doctrine. The aim of the work is to clarify how the legal concept of the acquisition of possession has evolved from common law models to a more practice-oriented doctrine. The author's research interests include the history of private law and civil law.
