Correcting the remuneration of works council members is fraught with pitfalls under labor, corporate, and criminal law for corporate officers. In this context, works council’s participation rights are easily overlooked. The author examines whether, and to what extent, the works council’s co-determination and participation rights - inter alia under section 87(1) no. 10 of the German Works Constitution Act (BetrVG), section 99 BetrVG, and section 80(2) BetrVG - must be observed when making correction decisions. The book also addresses data protection aspects as well as the practical implications of the Second Act to Amend the Works Constitution Act.
