Decisions relevant to labor law in international companies and groups are made abroad and information is monopolized accordingly. How is the co-determination and participation of works council committees in German sites structured in this case? This publication systematizes the current state of opinion and, for the first time, develops generally applicable guidelines that can be used to resolve all cases of a foreign decision-making center and information monopoly that are relevant under German works constitution law. As a lawyer specialized on labor law in a leading commercial law firm, the author has himself advised employers on several occasions in relevant cross-border cases.
