Demographic change presents new challenges for criminal law. Older individuals are particularly vulnerable to deception-based property crimes, as perpetrators deliberately exploit age-related limitations. The author analyzes common fraud schemes and perpetrator strategies, demonstrating that Section 263 of the German Criminal Code (StGB) does not yet adequately address the specific vulnerability of elderly victims. It proposes the addition of a standard example and a qualification to Section 263 StGB, along with accompanying preventive measures. The interdisciplinary analysis is intended for legal professionals, prosecutors and criminal policy makers.
