Description
The notarial deed in the digital age presents new opportunities, but also new challenges. The “Evidence” section of this book examines the implications for civil proceedings. The findings: the applicable patchwork of evidence rules leads to obstacles in the presentation of evidence with notarial deeds and implicates considerable contradictions to the “BeurkG” (German Notarisation Act). The “Legitimization” section explores pathways to an electronic executive copy. A combination of an (electronically) certified copy and a Validity Registry in the Electronic Deeds Archive appears to be most recommendable. Finally, a glimpse into the future - will further development of the Electronic Deeds Archive render the notarial documents “certified copy” and “executive copy” obsolete in the long term?
