In Germany, the expansion of onshore wind energy is increasingly encountering resistance from the local population as housing is progressively approaching the shore. The strengthening of civic wind farms compared to the sole operation by large energy companies offers the chance to regain acceptance for wind energy. In this context, the work is devoted to a series of questions that touch on different areas of law. In view of the limited availability of land suitable for the construction of wind turbines, the author examines whether and by what means, for example in terms of regional planning and constructional planning regulations and contractual instruments, areas can be specifically secured for community wind farms.
In addition, the reader learns to what extent the regulations of municipal law allow municipalities to participate in civic wind farms. Finally, various corporate forms are analysed with respect to whether they are suitable as a form of organisation of a civic wind farm.
