Bundesrechtliche Terrorismusabwehrmaßnahmen im Schnittbereich von Prävention und Repression

In recent years, federal counter-terrorism measures in Germany have been tightened and the point of intervention has been shifted far into the field prior to a specific attack. This causes a large-scale overlap between the possibilities for investigations under counter-terrorism law and those under criminal procedure, and is changing the operational orientation of the security architecture. These changes are particularly questionable from a proportionality point of view and are critically assessed in a legal comparison with the USA. As a result, this paper shows that there is a need for legal policy action and develops corresponding proposals for action.
