The participatory rights of injured persons are among the significant developments in modern criminal procedure. This study examines the criticism of these rights, focusing on access to case files under Section 406e StPO. It analyses historical, constitutional, European, and procedural foundations as well as insights from victimology and statement psychology. The study shows that objections to access to case files are largely unconvincing and that effective participation of injured persons is consistent with the guarantees of a rule-of-law criminal process. The author is an attorney-at-law researching victims’ rights, witness protection, and criminal procedure.
