Description
The bail-in instrument aims to protect Europe and the United States against the expansion of the next banking crisis into a financial market or sovereign debt crisis. However, the Single Point of Entry strategy developed by the FDIC and the European open-bank bail-in strategy are two diametrically opposed resolution strategies, neither of which has yet been tested in a real-world crisis.
In this study, the author investigates to what extent government authorities and politicians can influence or delay a resolution decision. Furthermore, a legal and procedural comparison between the US and European resolution frameworks is used to identify necessary short- and long-term measures to improve the viability of both bail-in instruments.
