Das Anwartschaftsrecht des Vorbehaltskäufers bei Rücktrittsmöglichkeit des Vorbehaltsverkäufers

The intention of this work is to veto the common opinion, that the buyer’s remainder does not extinguish if the seller obtains a right to revocation but only if such right is executed. This opinion is contradictory to the common definition of the buyer´s remainder. However the derived legal consequence of the common opinion is reasonable. This work analyzes the structure of the buyer´s remainder and provides for a juristic theory that justifies the legal consequences of the common opinion.
