Copyright protected material is also being created at research-institutions. This is often done by their employees. An important difference to non-research-institutions is the hierarchal structure. Furthermore, the contract design of the employees is different and influenced by the constitutional freedom of academic teaching and research. Nevertheless, modern research-institutions are increasingly interested in profiting from such developments and may therefore influence the way of publication. As a result, it is important to know when a work is a work-made-for-hire. This gets even more complicated, when more than one person is involved. The main part of this publication discusses this conflict in German law in detail. Finally, the author provides a short comparative analysis with American law.
