Das Beschäftigungsverhältnis in der Werkstatt für behinderte Menschen und seine Vereinbarkeit mit dem Recht auf Arbeit nach Art. 27 Abs. 1 UN-BRK

The dissertation examines how the legal relationship in the work area of sheltered workshops for persons with disabilities is to be classified in light of Article 27 CRPD. Within the multi-level framework of international, EU and German law, it identifies the requirements governing its legal design. Building on this, employee status and the employee-like legal relationship are analysed and the scope of application of labour and social law is determined. It then assesses remuneration, protection against dismissal, employee representation and the social security status of workshop employees against these requirements and identifies areas in need of legislative reform.
