Even several years after the GDPR came into force, central questions of GDPR fine proceedings have re-mained unresolved. While many issues are regulated directly by the GDPR itself, procedural questions of fine proceedings are mainly subject to national laws.
The thesis examines and solves central questions such as the culpability of legal entities, the determination of the relevant offence and the authorities’ discretion in the calculation of fines under German law.
The author was a deputy head of department at a German data protection authority and was entrusted with conducting fine proceedings. Afterwards, as a lawyer, he advised companies on defending them-selves in such fine proceedings.
