Description
The work addresses the question how far parental rights in the digital world reach and where limits are (must be) imposed by the state in order to balance them against the rights of the child. The subject of investigation are thereby the phenomena of sharenting and digital helicopter parenting. The legal analysis bases mainly on a constitutional, European and public international law perspective, but recurs also on national laws to analyse the actual implementation of the afore found human rights requirements. In particular, the german youth media protection (JuSchG) act and the youth labour protection act (JArbSchG) show certain gaps for the protection of children´s rights that need to be covered.
