Das Finalitätsprinzip und das Kausalitätsprinzip im Recht der Gesetzlichen Krankenversicherung

The paper investigates the existence of the so-called principle of finality, as well as the principle of causality concerning German law of statutory health insurance, since the existence of the first one is often singled out. First, the conceptuality at the basis for the paper is developed. The main part then analyses the selected codes, which apply to the treatment in case of disease, to point out final and causal structures that can express the existence of the appropriate principle. Since final as well as causal structures are established, the existence of both principles is one of the results of the paper. Resulting from the domination of the final structures in the analysed codes, another result is the prevalence of the principle of finality.
