The financing law of health insurances is a frequently discussed topic, but the real debate within this broad and controversial theme focuses on the dual health insurance system. Specifically, many question whether a parallel existence of the statutory and private health insurances makes sense from a socio political and competition political perspective.

This paper first analyses the financing laws of both the statutory and private health insurance, then takes the reform discussions into consideration and concludes with a constitutional debate.
