Under the concept of the contextual element, this work provides the first legal doctrinal assessment of collectivity in international crimes. This contextual element is a unique feature of crimes under international law compared to offences under national law. The doctrinal analysis of the work focuses not only on the classification as a procedural or material element in the system of criminal offences, but also on the identification of a legitimate attribution mechanism between collective events and the guilt of the individual. The results of the doctrinal analysis are then scrutinised with regard to institutions of the ‘general’ part of the ICC statute.
