The author examines the demands of the first women's rights movement regarding parental authority and guardianship at the time the German Civil Code was created, in particular the significance of motherhood for the legal status of women. The connection between the legal status of the mother, the demands of women's rights activists and the ideas of 19th century male jurisprudence opens up new perspectives on the role of law in the emancipation of women as mothers and the beginnings of feminist legal theory. The historical exegesis of sources also reveals conflicts within the historical school of law on the subject of motherhood and clarifies the intentions of the BGB legislators regarding the role of women in the family.
