Das Gleichheitsstreben im Unionsrecht als Herausforderung für den grundgesetzlichen Freiheitsanspruch

With the Egenberger (C-414/16) and Chefarzt (C-68/17) decisions, religion has suddenly become the focus of the European Court of Justice. On the occasion of these judgments of fundamental importance, the author addresses the following questions: How do the principles of freedom and equality relate to each other in the multi-level system? What frictional effects can be seen in the comparison of institutional foundations, the legal system and the case law of the respective supreme courts?
Based on the developments in the aforementioned areas, the author demonstrates the relevance of this area of tension between freedom and equality and presents approaches to resolving this increasingly apparent conflict.
