Description
This thesis examines the 2019 Hague Judgments Convention as an integral component of EU law, with particular emphasis on its role within European recognition law and the distinct features of its status as an EU treaty. Drawing on the foundational principles of recognition law and the framework of public international and EU law, the thesis analyses the interplay between the Convention and the Brussels Ia Regulation, along with the inherent tensions between them. Its central provisions – the concept of recognition, jurisdictional filters, and grounds for refusal – are examined from a doctrinal perspective. Finally, building on the direct effect of the Convention, the thesis develops standards for its implementation and administration within the EU, as well as for its application and interpretation as part of EU law.
