Das Institut der Präsidenten- und Ministeranklage in rechtshistorischer und rechtsvergleichender Perspektive

Current German legal doctrine especially in constitutional law does not explicitly focus on the procedure of impeachment. In particular, due to the insignificant practical relevance on federal level and on the level of the Länder, the use of this institute frequently is put into question. The author tries to rebut this assumption by means of a broad analysis taking into account both historical precedents and similar impeachment procedures in the European states and the USA.
The study impresses by disclosing a remarkable number of cases unknown in present legal doctrine. In particular, within the scope of the analysis, more than 170 attempts of impeachment leading to at least 29 sentences have been detected. By doing so the present study manages to close a gap on the line of demarcation between constitutional law and criminal law. It is addressed both to academics and practitioners in constitutional law.
