Description
The dissertation deals with the legal question of whether and, if so, on what grounds the prohibition of cartels can serve as a legal framework for bidding cartels in art auctions. Bidding rings are auction phenomena in which bidding competition is restricted by ring agreements and, as a result, the pricing of art auctions is manipulated. The starting point is a comparison of the general structure of markets and their protection by market regulation law with the structural characteristics of the art market and the art auction as an instrument typically used to determine price and value. The author explores various justifications for the applicability of § 1 GWB and concludes in the affirmative.
