Due to the slogans Erase and Be Forgotten, data subjects are under the impression that they could achieve a digital new beginning with the help of data protection law. In the course of seven chapters, the thesis explores the question of whether this protection is real or just the vision of the legislator.
The focus is on the legal requirements for the deletion process and to what extent it is technically feasible, an issue which has only been discussed superficially so far. By giving examples, the thesis outlines the legal and factual limits which result in a limited enforcement of the right to erasure and sometimes even achieve the opposite. Has deletion in data protection law become a utopia? Which adjustments to the existing legal framework could prevent this?
