The study examines the extent to which the ECJ's interpretative principles on the use of inside information have been implemented in the current market abuse regime (MAR and MAD II). The study focuses on the substantive and procedural effects of the so-called Spector rule. The author elaborates the dogmatic classification of this rule and examines its conformity with European law.
