Das nationale Milderungsgebot des § 2 Abs. 3 StGB unter dem Einfluss des europäischen Milderungsgebots des Art. 49 Abs. 1 S. 3 GRCh

National guarantees of criminal law, such as the requirement of mitigation under section 2(3) of the Criminal Code, cannot escape the influence of Union law. This is all the more true since the anchoring of European criminal law guarantees in the Charter of Fundamental Rights of the European Union. The thesis deals in depth with the question of the scope of application of the European mitigation requirement, especially in distinction to the national criminal law guarantee. The work is also devoted to the content and scope of the respective criminal law guarantee. The results of the discussion on the already established national principle of criminal law provide valuable clues for the interpretation of the still young European principle.
