Das Neutralitätsgebot des Grundgesetzes

The author addresses the dogmatic-systematic evaluation of the Basic Law's requirement of party-political and religious-ideological neutrality and deals in particular with the necessary demarcation from the neutralising effects of fundamental rights as rights of defence. She examines the scope of the powers of expression of the individual federal organs and, with regard to the members of the Bundestag, establishes the special feature of the lack of validity of a neutrality requirement. Finally, the author focuses on the demarcation and differentiation between the requirement of objectivity and the requirement of neutrality, which together allow for a constitutional assessment of the lawfulness of state statements.
