Das „Recht auf Reparatur“

The main repair barriers for consumers are the high cost of repairs and the lack of availability of repair services and spare parts. The right to repair has an inherent competition policy dimension that has not yet been sufficiently taken into account in legislative efforts. The canon of instruments of the right to repair is therefore extended beyond environmental and consumer law to include intellectual property law in particular. Furthermore, the potential of the right to repair within the warranty remains unutilised. Therefore, it is analysed in detail and presented how warranty law can contribute to the promotion of a repair culture.
